Terms of Services for Employer

Effective from: 01.11.2019

These Terms of Services govern the relationship between YOU and Workport Sp. z o.o. (including its subsidiaries, affiliates, agents, and assigns) ("Workport", "we", "us", "our") regarding your use of Workport’s website and/or mobile app, including your job offers posting, use of any other service(s) offered through them and your access to your Workport account information and service through them (collectively, the "Workport Service(s)" or "Service(s)").

BY USING THE WORKPORT SERVICES, YOU CONFIRM THAT YOU ACCEPT THESE WORKPORT TERMS OF SERVICES FOR EMPLOYER, AND YOU AGREE TO COMPLY WITH THEM.

YOU ALSO AGREE TO BE BOUND BY THE GENERAL WORKPORT TERMS OF SERVICES.

IF YOU DO NOT AGREE WITH THE ABOVE-MENTIONED DOCUMENTS, YOU MUST NOT USE THE WORKPORT SERVICES. WE RECOMMEND THAT YOU PRINT A COPY OF THESE TERMS FOR FUTURE REFERENCE.

In the event of making any changes to these Terms of Services, we will make a reasonable effort to properly inform you on its amendments. But it is your responsibility to review these Terms of Services as well as other documents, which apply to Employers, from time to time to see if anything has been changed.

All terms herein shall be interpreted with the same meaning as it determined in the General Workport Terms of Services.

1. Applying of these Terms

These Terms of Services apply to a person that offers or wants to offer jobs vacancies (post of employment) through the Workport Services (“Employer”, "you" or "your").

2. Applying of the General Workport Terms of Services

The General Workport Terms of Services apply to you too. You shall familiarize yourselves with the General Workport Terms of Services at the link: [workport.pl].

3. The Workport Services for Employer

Employer’s account grants you access to the following Services through the website [workport.pl] (“Website”):

  • Creating job offers and hiring ads;
  • Use of the messenger for communication with Applicants;
  • Use of management-system;
  • Accept and store documents.
  • Employers post job offers and hiring ads via the Website. The job offer is a common post of employment, while hiring ad is notification form about intent to hire the Applicant for one-time work. For convenience, every Employer has access to management-system that helps tracking Applicant’s interaction with job offers and hiring ads of the Employer.

    Workport has installed a tool that enables communication between authorized Users ("Messenger"). The Messenger can be usable after the Employer responds to the application or expressed a will to attract Applicant at concerned job offer on their own.

    4. Fees

    Workport has the right to charge fee for the Services. All costs of the Services are described in fee schedule at the Website. We can add/change our fee schedule at any time.

    Employer may prepay the Workport Services by loading money into own account. You are not eligible to assign or transfer any of your credits. Unused credits expire [180] days after their prepaid date.

    If it will be stipulated in fee schedule, Workport automatically withholds fee from Employer’s account every time job offer or hire ad posted by the Employer is clicked by the Applicant.

    5. Your Account and Content

    You shall complete registration at the Website to get access to all Workport Services for Employer.

    You must be either an individual entrepreneur or representative of a registered business entity, which has the right to provide job offers. You represent and warrant that you have the right, authority, and capacity to enter into the Agreement and to abide by all of the terms and conditions of the Agreement. You may not authorize others to use your account, assign or otherwise transfer your account to any other person or entity, and you may not be illegally registered entity or person that provides unlawful job opportunities for others.

    You are solely responsible for the content you publish or display at your account, job offers, hiring ads, or transmit to other users. When you provide information to Workport or other users, you agree to provide only true, accurate, current and complete information about yourself and you agree not to misrepresent your identity, job description, official duties, conditions of employment, salary etc.

    6. How You May NOT Use the Workport Services

    The information and Services available are provided by Workport for the purpose of Employers to recruit staff. You may use, print and download information from the Website for these purposes only and for no other personal or commercial purpose.

    It is prohibited to use the Workport Services as it determined in paragraph 5 of the General Workport Terms of Services.

    7. Deletion or Ban of Your Account

    We reserve the right to terminate the Services immediately and delete or ban your account in the case of breach of these Terms of Services. Illegal use of the Workport Services will be investigated and appropriate legal action may be taken, including without limitation, civil, criminal, or other proceedings.

    If we terminate the Services by reason of your violation of these Terms of Services, or at your request, you will not be entitled to, nor shall Workport be liable to you, for any refund of unused credits or paid fees for using the Workport Services.

    8. Your Processing of Applicant’s Personal Data

    Applicants provide you with personal data within applying to your job offers or hiring ads. You are a controller of such personal data and you determine purposes and means of the processing of personal data by yourself. Workport is not responsible for any operation or set of operations which is performed on Applicant’s personal data or on sets of personal data by you.

    You shall comply with all appropriate data protection laws. Also, you shall implement appropriate technical and organisational measures to ensure a level of security appropriate to the risks that are presented by processing, in particular from accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data transmitted, stored or otherwise processed.

    By using the Services, you may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Workport generally does not review content provided by User. You agree that we are not responsible for others’ content or information.

    9. Warranties

    Workport gives no guarantee as to the suitability of the Applicant to the job offered or as to the accuracy of the information provided by the Applicant.

    10. Trademarks

    Unless you have specifically told us otherwise, by providing us with your or an Employer’s logo, trade mark or other identifying symbol or description, you grant to us an irrevocable, perpetual, non- exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such logo or trademark for the Workport Services performance and marketing purposes.
